Abstract

Family mediation is an alternative to conflict resolution, which avoids judicial processes that delay the solution of a controversy that parents and children can reach through the figure of a mediator. Children and adolescents are subjects of law and have an active role in these processes that allow them to discuss problems that affect their rights. Consequently, their participation should be allowed. The methodology used for this study is documentary, to promote a critical-reflective analysis that allows identifying the benefits of the participation of children and adolescents in mediation. It is concluded that it is necessary to visualize the rights of children and adolescents from the principle of best interest and absolute priority.
