Abstract

This article analyzes from the perspective of criminal law and gender perspective, the investigation process carried out at the Public Prosecutor’s Office of the crime of trafficking in women between 2012 and 2019; for this, an applied methodology and descriptive analysis with a quantitative approach was designed; analyzing from a social legal perspective, the actions and results obtained in the investigation of the crime of trafficking in women from the law perspective. The report of this investigation is relevant, insofar as it makes possible to know the actions carried out by the State to collect evidence and fulfill a prosecution of the crime. As part of the findings, it was determined that El Salvador has shown progress in the regulation of the crime of trafficking in persons and the establishment of policies and protocols of persecution; however, the statistical results of the crime investigation process are negative, since they represent a low incidence in the punishment of crime, thus hindering the guarantee of victims’ rights, access to justice and favoring impunity.
