Abstract

The author presents here an overview of the ideas that have been consistently maintained over the three centuries of the application of Indian law in the Spanish colonies of America. This paper focuses on the question of the place of the Indians in the social system; therefore, issues such as the dignity of the Indians and the idea of justice in the colonial system deserve an important place here. The paper also dwells on the question of the encomienda, as a colonial social constitution, because much of the direction taken by Indian law was at stake around the debate that arose around it.
