The Place of the Indian in Indian Law

Abstract

In a brief discussion of the Indian Rights, the author presents a comprehensive view of the attempts to define the place of the Indians in the Spanish colonial system in America. Elements that favor the Indians, as human beings, alternate with actions tending to optimize the system, and with it, the Indians' exclusion. The article concentrates on the arguments given by Fray Bartolomé de Las Casa and the debate around the encomienda system, taking into account that it was there where the very existence of the colonial system was at stake.
