Abstract

The methods of alternate resolution of conflicts which are presented in this article define the mechanisms by which conflicts or claims between the parties can be solved. This article describes various methods such as mediation, conciliation, arbitration and interest-based negotiation (NBI), that materialize both in the administrative processes as well as in the judicial, in the same way shows how the negotiating capacities of the litigants in the new processes in which there is a predominance of oral tradition. At the same time I will explain the effects of the agreements and the force that can reach depending on to whom have been applied, all in accordance to the body of legislation of the Republic of Nicaragua in which we can found issues related to methods of alternate resolution of conflicts.
