Abstract

Human rights, as a discourse of human dignity, have been historically identified with the human nature and qualified as innate, universal, inalienable and non-derogable. However, the more substantial achievements of our times show that only from a critical perspective it is possible to challenge the traditional and conservative theoretical structures. Indeed, it is imperative to place the emphasis on the necessary discussions about the concept and the foundations of human rights, even from the point of view of the Inter-American System or Protection.
