Abstract

The presents work aims to carry out an analysis of the situation in Chile of civil servants, in the subjects of the labour law, in relation to the protection of their fundamental rights. In particular, the article examines the arguments that have been denied the protection of workers from the public sector, through the application of labor supervision procedure contained in the labour code and the jurisprudential swing that has allowed its admission in the Chilean law, realizing, finally, of the need for urgent legislative reform, to safeguard the principle of equality and legal certainty.
