Abstract

Latin American countries do not form a homogeneous reality from the social point of view economic and political. However, the process of historical and cultural training determined common factors, which allow general analysis about its reality. In the field of the labour law, common sources that influenced 1930 Mexican and Chilean laws in the process of consolidation in the shekel mid-twentieth specifically and the ILO conventions is attached to these factors. This article analyzes the reality that currently presents the labour law in Latin America and the main challenges facing in a context characterized by a dynamic contradiction between trends flexible flush and garantistas, by severe problems of effectiveness of legislation, by a strong presence of informal employment and self- mployment, protected by a large deficit in social security, the weakness of the trade union movement and difficulties in adapting the legislation to new forms of work organization and new technologies.
