Abstract

The establishment of the democracy as a means of social control, through a new Constitution in Ecuador from 2008, the Council of social Participation and Control has been constituted since the analysis of social participation, rights, representation, constituent processes, transparency and social control, and its normative regulation as the fifth power. Despite this dialectic, political, economic and structural crises occur periodically, due to the grade of cultural and educational delay of the population, the low level of human development and the absence of opportunities cause a culture of the illegality. The civil participation exists since the State exists.
