Abstract

 

Taking an exploratory analysis as base, this research intended to learn about the justiciability of sexual violence against women online by studying the Chilean judiciary, legislative and administrative institutional design as it influences the Access to justice and the effective guarantee for victims. The text starts by showing evidence on how the web represents a favorable environment for the offline world with breaching results for their fundamental rights. Then, the legal system was studied as well as the alternatives that those affected could take. It ends by proposing a judicial action route that would lead to put a halt on the effects of the distribution of audiovisual material without the consent from the women involved.
