Abstract

The legal design of the bank system, is like a specializing banking or as multiple banking (also so-called commercial banking or banking of investment), it affects in the systemic risk to which the bank system might remain exposed in every country. The experience of the American market was used such as illustration, every time, of a previous system to multiple banking, after the financial collapse of 1929, grow upto a system of specializing banking and, of this one, towards the current system of multiple banking, being this one the causes of the financial crisis of 2007-2008, which still has its effects. This essay does not try demonize to the multiple banking, indicating it like focus of financial instability and systemic risk. However, was it proposed is that whatever legislative system is adopted, the consequences that could arise from each one should be envisaged and the corresponding proceeds instituted.
