Environmental and mining legislation in Cuba. Successes and failures

The mining activity causes considerable damage to the environment, so it is necessary that each control adopt the legal norms that contribute to the mitigation of these. For this purpose, Cuba has implemented a policy supported by a legal basis, administrative and organizational basis that allows for its implementation, as well as the implementation of a comprehensive and integrated management of the environment. Therefore, the existence of a state organizational structure is necessary, with sufficient authority and competence for the implementation, execution and legal policy and environmental management aimed at achieving sustainable economic and social development. In this sense, the objective of this research is to carry out an analysis of the legal norms existing in Cuba that allow the environmental protection in the face of mining. For the realization of this research, theoretical methods of the legal sciences were used, among which are: Historical- legal analysis and exegetic analysis- legal, as well as the own methodology of the Social Sciences was used the technique of research review of documents.
