Abstract

The Nicaraguan mercantile legal system regarding the constitution of mercantile companies is out of date, its delay is evident as it has old legislation that does not comply with current international legal standards that are closely related to information and communication technologies and current mercantile practices that go hand by hand with the globalized economy. The purpose of this article is to demonstrate that a further telematics incorporation of commercial companies would benefit Nicaragua's public registry system and promote the creation of companies in an agile manner in which the bureaucratic processes that generally characterize any public administration are no longer a problem, taking as main references pioneer mercantile legislations of Spain and Peru in order to have as main axes their legislative and practical experiences in the matter of telematics constitution of mercantile societies, likewise, a brief analysis of the legal impediments that nowadays prevent the creation of companies of an expeditious form is offered and suppositions of lege ferenda are offered to solve these limitations.
