The objectives of this article are denouncing the mistakes made by the judges in probatory matter and how these situation quarrel with the theoretical basicses of this specialty. The method used essentially, is the critical observation of a number of judicial performances interesting, and deducing of them abstract and general conclusions. The main idea of the article, is the accusation of the serious situation that presents the administration of justice on the probatory topic that harms principles like the Necessity of the Evidence and the justification of the Rational Critic's establishment, and the necessity of providing urgent solutions to this problem.Downloads
