This paper aims to analyze the context currently experienced under the perspective of the Disaster Law. The approach is justified because of the fact that the guidelines established by such a legal branch allow an intersection with the Environmental Law, bringing light to some challenges faced by the legal system due to the risks that are present in the contemporary society and the necessity to promote environmental protection for current and future generations. Thus, the focus was to understand how the interpretation of the pandemic event in the light of the Disaster Law can assist in the accomplishment of the principle of intergenerational equity. The development of the present study is based on a deductive methodology, performed by a bibliographic review of doctrines and articles related to the subject. The main theoretical basis is the book “Direito dos Desastres”, by Délton Winter de Carvalho and Fernanda Dalla Libera Damacena.
