Abstract

Jurisprudence is a formal source of law, contemplated in the Honduran legal system, however, it has been granted an inferior legal value at the time of the application of positive law by the organs administering justice. In this sense, the objective of this article is to determine the consequences of the contradictions of jurisprudential theses, thus identifying if fundamental rights are violated with such contradictions, and if so, to specify the violated rights, and at the same time, propose solution mechanisms to counteract the effects that arise from the contradictions of jurisprudential theses, in amparo proceedings.
