THE APPLICATION OF THE LEGAL ACTION FOR THE DEPRIVATION OF OWNERSHIP OF ASSETS OF ILLICIT ORIGIN (APDBOI) AS A FACTOR OF IMPACT ON THE CREDIBILITY OF THE STATE’S ACTIONS: THE CASE OF THE STATE OF HONDURAS

This research aims to demonstrate the relationship between the applications of the legal action of the Deprivation of Ownership of Assets of Illicit Origin (DOAIO) deprivation with the credibility of the State.
As a methodology to carry out this research, a quantitative, non-experimental approach of a cross-sectional, correlational-causal type was used, for the collection of literature, the compilation of more than forty (40) scientific investigations (papers) was carried out, which contain binding information, obtained from indexed journals as well as the elaboration of an instrument to measure opinion and attitude that involves the responses of legally unionized personnel to the Honduran Bar Association (HBA), involving prosecutors, defense attorneys, judges, and prosecutors in general.
The study showed that 86.5% of the interviewees disapproved of the management of the administration and custody of assets by the State of Honduras in applying the Action for the Deprivation of Ownership of Assets of Illicit Origin (DOAIO), due to a lack of credibility in the performance of the action carried out by the authorities of the judicial system. Which includes investigative entities, the Public Prosecutor’s Office and the judiciary.
