LEGAL DOGMATICS: A FRAMEWORK BASED ON NON-LINEAR THEORIZATION

This paper defends a research framework aimed at providing epistemic and intersubjective improvements to legal dogmatics. To this end, it begins with a critique of legal dogmatics, following the objections raised by Carlos Nino and Riccardo Guastini. Considering these critiques, the paper examines Ricardo Guibourg’s proposal of law as an analysis of criteria, interpreting it in terms of an “accelerated” form of dogmatics. After reviewing the institutional limitations of law as an analysis of criteria, the study proposes a legal-dogmatic research framework oriented toward “non-accelerated” exchange, grounded in non-linear theorization schemes.
