In this article I present from the dogmatic-doctrinal analysis, the criminal responsibility of companies as a new active subject of crime, which has had a profound rejection by a strong doctrinal sector, but that has gradually been consolidated and more in the special part of the penal codes. This responsibility has been raised by the doctrine from two points or from two models of responsibility, each with its characteristics and with their respective criticisms, this responsibility is or was more common in the Anglo-Saxon countries, but as globalization entered business activity carried out in huge economic emporiums, it was representing a risk and a danger for society and for since a few years ago European continental law began its legal regulation from criminal law.
