THE ARTIFICIAL INTELLIGENCE (AI) REGULATION OF THE EUROPEAN UNION (EU): IT´S EXAMPLE AS A REFERENCE FOR A POSSIBLE FUTURE AI REGULATION IN HONDURAS

The following investigation has as a main goal to get to know the Artificial Intelligence (AI) Act of the European Union, which was approved on march 2024 by the European Parliament and by the European Union Council with the purpose of promoting the adoption of an Artificial Intelligence that does not violate citizens’ fundamental rights. This, with the objective that such Regulation may serve as a reference in the future for a possible AI regulation in the Republic of Honduras, since, as of today, no laws or regulations exist in the country that develop provisions and regulate the Artificial Intelligence Systems. For this reason, the topic was carried out and analyzed under three (3) approaches: 1. The relationship between Artificial Intelligence and Innovation; 2. Study and analysis of the Artificial Intelligence Act of the European Union; and 3. Study and analysis of the current status of the Artificial Intelligence legislation and regulation in the Republic of Honduras. In addition, Honduran legislation currently has laws that can be used as a starting point for creating this regulation, laws that are also being analyzed in the following investigation, so that, in this way, the country counts with a legal instrument that protects the fundamental rights of its citizens before the Artificial Intelligence advances.
