This study explains the idea that the Special Jurisdiction for Peace of Colombia should make use, in all cases, of its power to carry out its own juridical qualifications to strengthen the accomplishment of its special and transitory functions. It is argued that the International Law is the legitimate source to elaborate its own juridical qualifications as its construction is guided by the criteria of Restorative Justice. These criteria should be aligned with the fulfilment of the rights of survivors and the reintegration of ex-combatants. This idea is defended by considering that both domestic and international law by lack themselves the legitimacy to be contemplated without other application criteria.
