This article makes a theoretical review of the various concepts, object and scope of effective judicial protection. In addition, it reflects on the role of Alternative Dispute Resolution Mechanisms within the modern effective judicial protection in Mexico. It makes a tour of the main international legal instruments on human rights, with the aim of visualizing and identifying its positivization as a fundamental human right. It highlights the importance of motivating judicial resolutions and arguing in the field of Law. Lastly, it reviews the jurisprudence of the Inter-American Court regarding effective judicial protection.
