History of educational legislation in El Salvador: changes and continuities

The article aims to identify the alterations and continuities in the primary education legislation in El Salvador from 1940 to the present. The research question posed is: "What are the alterations and continuities in educational legislation in the country throughout its history?" To address this question, a qualitative research approach is assumed, supported by official documents, and the methodology of comparative education is employed, which does not seek to hierarchize laws but to place them in their historical, legal, social, political, and educational context, according to cited authors. Therefore, the comparative exercise is supported by general and specific categories and analyzes the level of total verification, partial verification, or non-verification in legal texts. The results of the study reflect changes in the boundaries that guarantee educational rights for children and adolescents, especially regarding access to school, evidencing variations in the structure of the educational system and the role of the State in its fulfillment, concluding the need to broaden the debate on how to ensure rights that have not been covered until today in harmony with international trends. This article is expected to provide inputs for the study and improvement of educational legislation in future laws.
