Repercussions of the Misuse of Freedom of Expression: Hate Speech and the Rule of Law

The rise of digital platforms has radically transformed the way we communicate, but it has also led to a worrying increase in hate speech. This practice, which undermines freedom of expression and the fundamental principles of the rule of law, requires in-depth analysis. This essay explores the implications of hate speech in the digital realm, examining its impact on social cohesion and democratic governance. It seeks to identify the challenges and opportunities posed by the coexistence of freedom of expression and the need to protect people from hate speech. First, it analyzes how hate speech limits freedom of expression and undermines the pillars of the rule of law. Next, it explores the legal and regulatory tools available to combat this problem. Finally, recommendations are proposed to improve the protection of freedom of expression in the digital environment, minimizing the risks associated with hate speech. This paper seeks to contribute to the academic debate and lay the groundwork for future research and public policy. By addressing the challenges and risks of hate speech, it aims to strengthen the rule of law and ensure responsible freedom of expression in the digital environment.
